fa همزیستی مسالمت‌آمیز بین‌المللی در پرتو قاعده الزام تخصصي Special پژوهشي Research <div style="text-align: justify;">قاعده فقهی &laquo;الإلزام&raquo; از جمله قواعد بنیادین فقه اسلامی است که با پذیرش آثار حقوقی التزامات اشخاص براساس نظام اعتقادی و حقوقی مورد قبول آنان، ظرفیت مهمی برای تحقق &laquo;دیگرپذیری حقوقی&raquo; و مشارکت فعال فقه اسلامی در فرآیند جهانی‌شدن حقوق فراهم می‌آورد. این مقاله با رویکردی تحلیلی&ndash;انتقادی و با استفاده از روش توصیفی&ndash;تحلیلی، به بررسی مبانی فقهی و اصولی قاعده الإلزام پرداخته و با طرح دیدگاه‌های فقیهان برجسته امامیه و اهل‌سنت و نیز حقوق‌دانان معاصر غربی، کارکردهای این قاعده را در حوزه حقوقی، تجارت بین‌الملل، حقوق بشر و حقوق اقلیت‌ها در اسناد بین‌المللی تحلیل می‌کند. یافته‌های پژوهش نشان می‌دهد که قاعده الإلزام، در صورت بازخوانی اصولی و تبیین دقیق حدود آن، می‌تواند به‌عنوان یک ظرفیت هنجاری بومی، زمینه تعامل سازنده میان فقه اسلامی و نظم حقوقی جهانی را فراهم و به تقویت همزیستی مسالمت‌آمیز و گفت‌وگوی حقوقی بین‌فرهنگی کمک کند.</div> <div style="text-align: justify;">The jurisprudential rule of Ilzām is one of the fundamental principles of Islamic jurisprudence that recognizes the legal consequences of individuals&rsquo; commitments based on their own religious or legal systems. This rule possesses significant potential for promoting legal other-acceptance and enabling Islamic jurisprudence to engage constructively in the global legal order. Adopting a descriptive&ndash;analytical and critical approach, this article examines the jurisprudential and legal foundations of the rule of Ilzām, while translating and critically assessing the views of prominent Shiʿi and Sunni jurists as well as contemporary Western legal scholars. Furthermore, it analyzes the applications of this rule in international law, international trade law, human rights, and minority rights as reflected in international legal instruments.
